1. scope

These General Terms and Conditions (GTC) govern the rental relationship between the customer and Veleras International GmbH – Subeez.

2. conclusion of contract

2.1 The rental of electric tuk-tuks is carried out exclusively on the basis of these GTC. By booking an electric tuk-tuk, the customer accepts these conditions.

2.2 The booking can be made in person, by telephone, by e-mail, by WhatsApp or via the Subeez online booking platform.

2.3 Subeez reserves the right to refuse a booking request without giving any reason.

3. rental period and use

3.1 The rental period begins at the agreed time and ends at the agreed time, unless an extension has been agreed.

3.2 The customer may use the electric tuk-tuk only for private or commercial purposes and is obliged to treat the vehicle properly.

3.3 The electric tuk-tuk may not be passed on or sublet to third parties unless this has been expressly agreed with Subeez.

4. rental prices, cancellation and terms of payment

4.1 The rental prices shall be based on Subeez’s prices valid at the time of booking.

4.2 Payment shall be made in advance or at the time of delivery of the vehicle in cash or by electronic payment method as agreed.

4.3 In case of cancellation of the booking by the Customer, the cancellation terms of Subeez, which were communicated to the Customer at the time of booking, shall apply.

4.4 Cancellation by the customer

4.4.1 In case of cancellation of the booking up to 48 hours before the agreed start of the rental period, the customer will not be charged any cancellation fees and any payments made will be fully refunded.

4.4.2 In case of cancellation of the booking within less than 48 hours before the agreed start of the rental period, Subeez shall retain a cancellation fee of 50% of the total rental price. Any payments made will be reduced by this cancellation fee and the balance will be refunded to the customer.

4.5 Cancellation by Subeez

4.5.1 Subeez reserves the right to cancel the booking for good cause, e.g. due to technical problems with the vehicle or other unforeseeable circumstances.

4.5.2 In case of cancellation by Subeez, the Customer shall be refunded the full amount paid. Subeez will endeavor to provide the Customer with alternative solutions, if available.

4.6 Changes to the booking

4.6.1 The Customer may make changes to the booking, e.g. an extension of the rental period or a change of the pick-up and drop-off time, provided Subeez agrees and availability is given.

4.6.2 Any changes to the booking may result in an adjustment of the rental price, depending on the nature of the change and Subeez’s current prices.

5. deposit

5.1 Subeez may require the Customer to pay a deposit to cover any damage or loss to the Vehicle.

5.2 The deposit will be returned to the customer after proper return of the electric tuk-tuk, less any costs for damage or loss.

6. insurance

6.1 Subeez shall provide liability insurance for the Vehicle that partially covers damage to third parties. The deductible is CHF 1000 and must be paid by the customer.

6.2 The customer is responsible for any damage to the electric tuk-tuk that occurs during the rental period. The customer is liable for such damages.

7. liability

7.1 Subeez shall not be liable for any damage caused to the Customer or third parties by the use of the electric tuk-tuk, unless the damage was caused by gross negligence or intent on the part of Subeez.

7.2 The customer is liable for all violations of road traffic regulations or other legal provisions during the rental period.

8. data protection

Subeez collects and processes personal data of the Customer only within the scope of the applicable data protection laws and exclusively for the purpose of processing the contract.

9. final provisions

9.1 Amendments or supplements to these GTC must be made in writing.

9.2 Should individual provisions of these GTC be invalid or unenforceable, this shall not affect the validity of the remaining provisions.

9.3 The place of jurisdiction and performance for all disputes arising from the rental relationship is the registered office of Veleras International GmbH – Subeez.
